General App Reservation
Your participation in the launch reservation program is subject to the following terms and conditions (“Terms”):
- Availability: Foot Locker App reservations are available for select products in the contiguous 48 United States. To check which retail stores are participating in the Launch Reservation procedure, head to the Releases tab in the App which displays all upcoming shoe releases and the method by which customers can request a reservation for a release shoe.
- Participation Eligibility: You may request a reservation as long as you are at least 13 years old and a U.S. resident in one of the contiguous 48 United States and intend to use the shoes for your own personal, family or household purposes, and not for resale or other commercial purposes. Employees of Foot Locker, Inc. and its subsidiaries (“Foot Locker”), as well as the immediate family and household members of those employees, are not eligible to make requests. Foot Locker reserves the right to decline to allow you to participate in any launch reservation in its sole discretion if it has cause to believe you do not meet these eligibility requirements or if your participation would violate these Terms, any restrictions or limitations that Foot Locker places on purchases, orders, reservations, or offers, or the terms and conditions of any other offers or programs offered by Foot Locker.
You must also be a member of FLX Rewards to participate. - How to Request a Reservation: Follow the instructions on the App to request a reservation. You are allowed to submit a reservation using only one account. You will have the opportunity redeem points for Xtra Boosts. Please note that once you redeem the points you will not get them back, even if you do not receive an invitation to purchase shoes. Multiple accounts used by an individual in an attempt to reserve more than the limited quantity per launch will not be considered. Do not change your username and email address during the reservation process (it must match from submission, through reservation confirmation and pick-up) or a successful reservation will not be considered. Each reservation opportunity will have its own deadline. After the deadline, you will receive a push notification on the App reminding you to check whether your reservation submission attempt was successful.
- Reservation options: Reservations options include “store pick-up” and “ship to me.” If you choose the “store pick up option,” your reservation submission is successful and if you confirm you want to purchase the shoes within the allotted time, you must pick up the shoes in person at the designated store. If you choose the “ship to me” option, at this time you must use a credit card to make the reservation and pay if your reservation submission is successful. You agree that Foot Locker may place a temporary hold on your credit card for the full retail purchase price of the shoe plus any taxes, shipping and handling, as applicable, pending the outcome of the reservation process.
- Purchase Process for Successful Reservations:
“Ship to me” option: If your reservation submission attempt was successful for the “store pick-up” option, the credit card you used for the reservation will be charged automatically for the full retail purchase price of the shoe plus any taxes, shipping and handling, as applicable, and the shoes will be shipped to the primary shipping address associated with your account.
“Store pickup” option: If your reservation submission attempt was successful for the “store pick-up” option, you must confirm whether you want to purchase the shoes within the allotted time. You will then be given instructions on how to purchase the shoes at a specific store and at a specific date and time. To purchase the shoes, you must show a valid photo ID that matches the name on the list. Anyone who does not purchase or pick up the shoes by the deadline in accordance with these requirements will not be allowed to purchase the shoes. Foot Locker reserves the right to extend the deadline for special circumstances at Foot Locker’s sole discretion, and to substitute shoes if the reserved shoes are not available for any reason. - Restrictions on Use of Gift Cards and Other Forms of Payment:
Selecting the “ship to me” option for launch products currently requires use of a credit card for the reservation and ultimate purchase for successful reservation submissions. Gift cards and other forms of payment may not be used for the “ship to me” option at this time. Use of a Foot Locker gift card in connection with a purchase of reserved shoes in-store option is subject to the terms and conditions applicable to Foot Locker gift cards, available at footlocker.com/giftcards.html, as well as these Terms.
If Foot Locker suspects that gift cards or any other forms of payment are being obtained, used, redeemed, or applied to any purchase, reservation, or order contrary to these Terms, the gift card terms and conditions, restrictions or limitations that Foot Locker places on purchases, orders, reservations, or offers, or the terms and conditions of any other offers or programs offered by Foot Locker, Foot Locker reserves the right, in its sole discretion and without prior notice to you, to: (a) cancel, suspend, or limit any purchases, orders or reservations, (b) refuse to accept gift cards in connection with particular purchases, orders, or reservations, (c) limit the number of gift cards that may be used for any purchase, order or reservation, (d) require an alternative form of payment, and/or (e) cancel, suspend, or terminate accounts, memberships or the ability to use certain services or programs. If Foot Locker takes any of these actions, Foot Locker will not refund any points you redeemed for Xtra Boosts. - General Conditions: By requesting a reservation, you indicate your agreement to these Terms and Foot Locker’s discretion to make decisions regarding the Program. In the event that the reservation process is impaired in any way, Foot Locker reserves the right to modify or cancel the process.
Foot Locker reserves the right to disqualify and seek damages from any individual who tampers with the operation of the Program, violates these Terms, or acts in a disruptive manner. In such cases, Foot Locker will not refund any points the individual had redeemed for Xtra Boosts. Foot Locker’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision. - Limitations of Liability: By participating, you agree that Foot Locker, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents shall not be liable to you or any third party for: (a) any damages arising out of your participation in the Program except to the extent caused by Foot Locker’s intentional misconduct, recklessness, or gross negligence, and (b)any indirect, special, punitive, incidental or consequential losses or damages, including lost profits, regardless of whether such damages were foreseeable and regardless of whether we were advised of the possibility of such losses or damages. These limitations shall apply to all claims and theories of liability to the fullest extent allowed by applicable law.
- Privacy: Information you submit as part of the Program will be governed by the App’s Privacy Policy.
- Disputes: You agree that any disputes, claims, and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of Foot Locker in connection with the Program, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York. - Additional Details: For additional requirements and details, please see our Launch Reservation FAQ.
Official Rules for Sneaker Launch Sweepstakes
There is no purchase necessary to enter.
- Eligibility: The Sweepstakes is open to U.S. residents in one of the contiguous 48 United States. However, employees of Foot Locker Retail, Inc. (“Sponsor”) or its sister companies, as well as the immediate family and household members of those employees, are not eligible to enter.
You must also be a member of FLX Rewards to participate. - How to Enter: When you pick up a ticket, you will be asked for your name, selected shoe size, and telephone number. You will also be required to show a valid photo ID. You may only enter one (1) time. Additional entries will be disqualified.
- Drawing and Prize: Sponsor will select one (1) potential winner per available sneaker per store and will attempt to notify winners by phone. Each winner will have the right to buy the sneaker upon launch.
- Requirements: If your ticket number is drawn, you must be at the store at the specified date and time and show a valid photo ID that matches the name on the list in order to purchase the sneaker. If the name on the ID doesn’t match the name on the list, you will not be allowed to purchase the sneaker.
Anyone who does not purchase the sneaker by the deadline in accordance with these requirements will forfeit the opportunity to buy the sneaker, and Sponsor may offer that opportunity to another person. Sponsor reserves the right to substitute a prize if the prize is not available for any reason. - Restriction on Use of Gift Cards and Other Forms of Payment. - General Conditions: By entering, you indicate your agreement to these Official Rules and Sponsor’s decisions regarding the Sweepstakes. In the event that the operation of the Sweepstakes is impaired in any way, Sponsor may award the prizes at random from among the eligible entries received up to the time of the impairment.
Sponsor reserves the right to disqualify and seek damages from any individual who tampers with the operation of the Sweepstakes violates these Official Rules, acts in a disruptive manner, or Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that term. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited. - Release and Limitations of Liability: By entering, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize.
To the fullest extent allowed by applicable law, you waive the right to claim any attorney’s fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. - Privacy: Information you submit as part of the Sweepstakes will be used for purposes of this Sweepstakes.
- Disputes: Unless otherwise prohibited by law, you agree that any disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York.
